Freedom of Information-Request for Records

Illinois Statute 5 ILCS 140/4 requires each public body to post specific information regarding the public body as part of the Freedom of Information Act (FOIA).A FOIA request can be submitted in person, via facsimile, via mail, via e-mail, or by some other means of mail delivery service. The request needs to be filled out on the Freedom of Information Request Form.

Under the Illinois Freedom of Information Act (5 ILCS 140), public bodies may charge reasonable fees for reproducing records, with the first 50 pages of black and white, letter/legal-sized copies free. Additional pages cost up to 15 cents each, while electronic records and “voluminous” requests have specific, higher fee structures. 
Standard Fee Structure
    • First 50 Pages: Free (black and white, letter or legal size).
    • Additional Pages: Maximum \(\$0.15\) per page.
    • Color/Specialized Copies: Actual cost of reproduction.
    • Electronic Records: No charge for electronic, unless it falls under voluminous or special data format requirements.
    • Staff Time: No fees for staff search time for standard requests.

Voluminous and Commercial Request Fees 
  • Voluminous Requests: If a request is deemed “voluminous” (5 ILCS 140/6), specialized electronic fees apply based on data size (PDF vs. non-PDF) ranging from \(\$20\) to \(\$100\).
  • Commercial Requests: Public bodies can charge up to \(\$10\) per hour for search/retrieval time after the first 8 hours, along with actual costs for retrieving off-site records.
